Terms of Service
1. Agreement
These Terms of Service ("Terms") are a contract between you and Maxxer ("we", "us"). By downloading, installing, or using Maxxer, you agree to these Terms. If you don't agree, don't use the service.
2. The service
Maxxer is a macOS productivity tracker and subscription. We grant you a personal, non-exclusive, non-transferable license to use the software on Macs you own or control, for as long as your subscription is active.
3. Accounts
You must be at least 13 years old to create an account (16 in the EU). You're responsible for keeping your credentials secure and for activity on your account. Notify us immediately at support@maxxer.app if you suspect unauthorized access.
4. Subscriptions and billing
- Plans, prices, and billing periods are shown on our pricing page.
- Subscriptions renew automatically at the end of each billing period until you cancel.
- You can cancel at any time from your account settings; cancellation takes effect at the end of the current period.
- Prices exclude applicable taxes, which are added at checkout.
- We may change prices for future billing periods with at least 30 days' notice.
5. Free trial
New accounts may be offered a free trial. At the end of the trial, your subscription begins at the plan you selected unless you cancel first. We may limit trial eligibility to one per person.

7. Acceptable use
You agree not to:
- Reverse engineer, decompile, or attempt to extract source code from the app.
- Resell, redistribute, or sublicense the app without written permission.
- Use the app to violate any law, or to infringe anyone's rights.
- Interfere with the service or attempt to gain unauthorized access.
- Automate the creation of accounts or scrape our services.
8. Ownership
Maxxer and its logo, code, designs, and content are our property or that of our licensors. Nothing in these Terms transfers ownership to you.
9. Your data
You own the activity data your device produces. By using cloud sync or leaderboards, you grant us a limited license to store and process that data as needed to run the service, per our Privacy Policy.
10. Termination
You can stop using Maxxer at any time. We can suspend or terminate your account if you materially breach these Terms, if we're required to by law, or if we're winding down the service. On termination, your license ends and we'll delete or return your data as required by law.
11. Warranty disclaimer
Maxxer is provided "as is" and "as available." To the fullest extent permitted by law, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement.
12. Limitation of liability
To the maximum extent permitted by law, our total liability arising out of or relating to the service is limited to the amount you paid us in the 12 months before the event giving rise to the claim. We are not liable for indirect, incidental, or consequential damages.
13. Indemnity
You'll indemnify us against third-party claims arising from your misuse of the service or your breach of these Terms.
14. Governing law
These Terms are governed by the laws of the State of California, without regard to conflict-of-law principles. Disputes will be resolved in the state or federal courts located in San Francisco County, California, and you consent to their jurisdiction.
15. Changes
We may update these Terms. If we make material changes we'll notify you by email or in-app. Continued use after the effective date means you accept the changes.
